Over the summer, the Home Office announced changes to rules applicable to HTS applications or renewals. Also see updates on the Right to Study guide.
Amongst the changes, the maximum visa refusal rate allowable for successful HTS applications has been reduced from 20% to 10%. This change is due to take effect for HTS applications and renewals made from 1 November 2014.
ISC contacted the Home Office expressing our concerns as to the impact this policy change will have on schools. The Home Office responded stating that they “will continue to consider low users of CAS on a case by case basis due to the disproportionate effect refusal of one CAS can have on the HTS calculations”. The Tier 4 sponsor guidance has been updated to incorporate the changes to HTS and now contains a specific section on sponsors issuing fewer than 50 CASs. Given that the change could still have a disproportionate effect on schools that issue a low number of CAS but more than 50 each year, ISC wrote to the Immigration Minister setting out these concerns. Right to Study guide
In October last year ISC reported that we were discussing with the Home Office the production of a guide for schools on the reasonable steps that should be taken to comply with the duty to check that all students have the right to study in the UK. After several months, ISC have finally received a letter from the Home Office enclosing the note.
