New SEND guidance

DfE has published a series of guidance documents explaining the reforms to the SEND regime and the transitional arrangements that apply.

The guidance documents that have been published so far include:

SEND: managing changes to legislation from September 2014
SEND: guide for schools and alternative provision settings
Section 41 Secretary of State approved List
Special educational needs and disabilities (SEND) reform: letters
Supporting pupils at school with medical conditions
SEND: guide for social care professionals
SEND: guide for further education providers
SEN and disability support changes: information for young people
Early years: guide to the 0 to 25 SEND code of practice

ISC is meeting with DfE officials to discuss producing a document specifically for independent schools on the section 41 list and relevant early years’ providers.

In response to a specific request from ISC, the Code of Practice now includes wording which clarifies the extent of its application to independent schools:

"Where an independent school offers funded early years provision, it has to have regard to the 0-25 SEND Code of Practice only in respect of that provision – the Code does not cover their main school provision (unless they are on the list of independent schools approved by the Secretary of State under Section 41 of the Children and Families Act 2014)."
