NMS for boarding schools and residential special schools

DfE published the revised National Minimum Standards for boarding schools and National Minimum Standards for residential special schools at the end of March. The Standards are in force from 1 April 2015.

Small Business, Enterprise and Employment Act 2015 – Ofsted registration

The SBEE received Royal Assent on 26 March. One of the main changes to impact schools is the extension of the exemption from Ofsted registration that schools already have for taking children aged three and above. The extension means that, from 26 May, schools will not be required to register separately with Ofsted for provision for two-year-olds.

DfE has informed ISC that they do not currently intend to extend the exemption (which independent schools can apply for) from the learning and development requirements of the EYFS to children aged two. In addition, there will not be an exemption for ‘rising twos’ in the same way there is for ‘rising threes’. The exemption from registration applies to children from age two upwards and the free entitlement for two-year-olds is only payable from the term after the child turns two.

Regulations have been drafted that will cease any early years registration that is no longer required as a consequence of the Act; however, schools will still have to confirm with Ofsted that their two-year-olds’ provision meets the requirements for exemption. Schools should be contacted shortly by Ofsted outlining how the process will work.

The DfE has produced a childcare and schools factsheet which sets out some of the new measures in the Act, the aims behind them and the outcomes and impacts.
