School Regulation and Inspection

Independent schools are subject to a complex array of legal and regulatory requirements, and new legislation or policy is always under consideration.

ISC works on the sector’s behalf to reduce unnecessary red tape whilst maintaining sensible standards and inspection reports in which parents can have confidence.

The Charity Commission has:

  • launched a new trustee welcome pack, which will be emailed out to all new trustees by the Commission;
  • issued another alert warning charities about the increase in CEO fraud, where fraudsters impersonate senior figures at charities and then request transfers of funds. The most recent reports have involved targeting of schools where fraudsters have falsely claimed to be the head teacher or principal;
  • issued guidance in conjunction with the Fundraising Regulator about the requirements under the 2016 Act for charities above the audit threshold to include certain statements about fundraising in their trustees’ annual report.

GDPR

  • The ICO has updated its self-assessment toolkit for small to medium sized businesses.
  • The ICO has updated its guide to GDPR with a monthly timeline included on what’s new.
  • The ICO has produced a lawful basis interactive guidance tool to provide guidance on which lawful basis is likely to be the most appropriate for processing activities.
  • SWGfL, a partner in The UK Safer Internet Centre, has published advice and guidance to help schools and colleges when it comes to managing personal data. It has also published questions to support the Governing Board/Trustees/Directors.
  • The DfE has published guidance to support schools with data protection activity. As the guidance is entirely new content, the DfE is asking that schools provide feedback by 1 June 2018 by sending comments to data.modernisation@education.gov.uk with the subject heading ‘GDPR toolkit feedback’.
  • The ICO has posters and campaign materials available as part of the Your Data Matters campaign which will be launched on 25 May 2018.
