Employment Law update - November 2013

Changes since the last update and those to come in.

Changes since August 2013

  1. Employment Tribunals (Constitution and Rules of Procedure) (Consequential Amendments) Regulations 2013 in force – 30 August

  2. Employee shareholder status – 1 September 2013

  3. Occupational and Personal Pension Schemes (Automatic Enrolment) (Amendment) Regulations 2013 come into force – 14 September

  4. EAT ruling has capped the holiday allowance that employees are able to automatically carry over while absent on long-term sick

  5. EAT considers whether it is a ‘reasonable adjustment’ for an employer to pay for private counselling if an employee is suffering from work-related stress and depression

Legislation in Force from 1 October 2013:

  1. Third party harassment provisions in Equality Act to be repealed

  2. National Minimum Wage to increase

  3. Changes to strict liability

  4. Proposed changes to first-aid requirements

  5. New rules on directors pay

  2. Police Act 1997 (Criminal Records) (Amendment No.2) Regulations 2013 come into force – 2 December

  3. Proposed changes to transfer of undertaking protection of employment (TUPE) – expected January 2014

  4. Mandatory early conciliation – expected 6 April 2014

  5. Employer allowance introduced for NI contributions – expected 6 April 2014

  6. Discrimination questionnaire procedure to be repealed – expected 6 April 2014

  7. Financial penalties imposed on employers that breach employment rights - expected 6 April 2014

  8. Right to request flexible working extended to all employees – expected Spring 2014

  9. New approach to managing sickness absence introduced - expected Spring 2014
