Employment Law update - August 2013

Changes since the last update and those to come in.

Changes so far this year:

  1. National minimum wage entitlement for apprentices
  2. New tribunal award limits
  3. Increase in weekly tax relief for childcare
  4. Changes to national insurance and income tax thresholds
  5. Pensions auto-enrolment thresholds amended
  6. Collective redundancy consultation period reduced to 45 days
  7. Statutory sick pay and statutory maternity, paternity and adoption pay increases
  8. Real time information introduced for PAYE deductions
  9. Basic state pension increases
  10. Whistleblowing rights amended
  11. Whistle-blowing - Public Interest Disclosure
  12. Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (Amendment) (England and Wales) Order 2013 comes into force
  13. Qualifying period for unfair dismissal claims for political opinions removed
  14. Portable DBS checks introduced
  15. Duty to participate in education or training until 17 comes into force
  16. Enterprise and Regulatory Reform Act 2013 amends tribunal procedure and awards
  17. Police Act 1997 (Criminal Record Certificates: Relevant Matters) (Amendment) (England and Wales) Order 2013 comes into
  18. Parental leave increased from March 2013 and further changes planned over the next two years

Recent changes (in force from 29 July 2013):

  1. Compromise agreements renamed settlement agreements

  2. Pre-termination negotiations become inadmissible in unfair dismissal proceedings

  3. Fees for tribunal claims introduced

  4. New employment tribunal rules

  5. Reduced cap on the compensatory award for unfair dismissal introduced

  6. Employment Tribunals (Interest) Order (Amendment) Order 2013 comes into force

  7. Employment Tribunals (Interest on Awards in Discrimination Cases) (Amendment) Regulations 2013 come into force

Upcoming changes:

  1. Third party harassment provisions in Equality Act to be repealed - (expected in October 2013)

  2. Proposed changes to transfer of undertaking protection of employment (TUPE) - expected in October 2013

  3. National Minimum Wage to increase – 1 October 2013

  4. Changes to strict liability - (expected in October 2013)

  5. Proposed changes to first-aid requirements - (expected in October 2013)
