Revised version of SEND Code of Practice

Following the public consultation on the draft SEN Code of Practice and Regulations in autumn last year, DfE published a revised code of practice for further and more specific consultation earlier this month. The consultation period was short and ISC submitted a short response on the key issues. Whilst we still do not know what the final version will look like, please see the revised draft that was consulted on.


There has been concern from a few ISC schools about the impact that the new funding arrangements will have on pupils that are on statements (soon to become EHC plans). Some schools have been asked by local authorities to demonstrate how they have met national thresholds. ISC has confirmed with DfE that there has been no change to the way in which independent schools are funded and local authorities asking independent schools to meet thresholds are wrong.

DfE are still in the process of considering how schools that apply to be on the section 41 approved list are to be treated and also how schools that are not on the list will be treated going forward. They have agreed to put something in writing to ISC confirming that the current funding arrangements do not affect independent schools which may be helpful to schools that are currently facing difficulties with local authorities.

Supporting pupils with medical conditions in school

Following consultation earlier this year, DfE has published proposed guidance and advice to ensure that pupils with medical conditions receive appropriate support in schools. The new guidance is not statutory guidance for independent schools; however some schools may find the contents useful.
