Counter Terrorism and Security Act 2015

The Counter Terrorism Bill obtained Royal Assent on 12 February 2015. ISC liaised with ASCL on lobbying efforts to change the way in which the Act brings schools into the scope of the prevent duty. Despite the concerns expressed, the Bill rapidly progressed through parliament. While the Bill was going through parliament a consultation was launched on the statutory guidance to be produced under the Act which all schools will be required to have regard to. ISC responded fully to the consultation and expressed concern at there being another set of statutory guidance for schools to comply with. ISC are now lobbying for the proposed additional duties, which should fall under safeguarding, to be added to KCSiE (Keeping Children Safe in Education) so that schools do not have another set of guidance that they must have regard to. The Home Office seems interested in this proposal and ISC will continue to liaise with them.

NMS for boarding schools and residential special schools

DfE has launched a consultation inviting a limited number of stakeholders to comment on the revisions to the National Minimum Standards for Boarding Schools and the National Minimum Standards for Residential Special Schools. ISC is liaising with BSA and responding on behalf of the sector.

The new version of the essential trustee (CC3)

The Charity Commission published a consultation on proposals to strengthen the Essential Trustee document (CC3) so that trustees understand their role and responsibilities. ISC liaised with AGBIS and submitted a response on behalf of the sector.

Prohibition from management checks

DfE is close to having a system in place for carrying out s128 checks and will be informing ISC once this is available for circulation so that schools can undertake the relevant checks.
